b) Other personal data

The use of our (mobile) websites involves the automatic collection of data through cookies or other systems that record information. The type of data covered in this section includes in particular the IP address, the device used, the website visited or the application used, the language and the type of browser. Prior identification is sometimes required when using certain (mobile) websites.

The categories of personal data depend on the service used. By way of example, we refer to
the following data:

1) data arising from your interactions on the pages dedicated to the various social networks, if you consent to this type of data processing.
2) identification data such as hashed email addresses, IP address, device fingerprinting data, latitude and longitude.
3) demographic information such as location, age bracket, gender and other demographic data specified by the individual (linked to an identifier).
4) when you browse one of our (mobile) websites, data relating to your behaviour and habits regarding the use of the various distribution and communication channels may be recorded, which includes in particular:

  • location data enabling you to be located approximately;

Please note that we use your location data on certain sites to deliver advertising tailored to your location.
In this case, you must first give your free, explicit, unambiguous and informed consent. You can deactivate this feature at any time in your phone settings.
With regard to location data, we proceed as follows: we adjust our advertising system so that the advertisement is displayed on every mobile phone located in the defined region on which the application is open. If you have deactivated your location data or if you are not in the defined region, you will receive
different or general advertising.

  •  the duration of your use of our services and products, when you use them and how often;

  •  the device, system software or browser used.

The other data is collected in order to give you the best possible experience across our various web platforms. Through automated data processing, we improve our services and products so that they are personalised and tailored to your needs and wishes.

c) Monetisation platforms and social networks

On some of its websites, Edition Ventures works with monetisation platforms. These make it possible to monetise the content of our websites or content generated on social networks by creating affiliate links.

A monetisation platform works as follows: a unique identification number is assigned to each user and transmitted to an affiliate network (unless you have disabled the cookies specific to that platform); this makes it possible to determine whether the user clicked on the link or made a purchase on the merchant's website.

Our website therefore contains affiliate marketing links integrated through a monetisation platform via Skimlinks. When we write about a product or service of a merchant associated with the Skimlinks affiliate network, we receive a commission on the sales generated through the links created. Also, as an Amazon Associate, we earn from qualifying purchases.

To this end, we may store users' IP addresses and also determine their location data. For example, we collect this information when you click on a commercial link [embedded on one of our sites] that takes you to a merchant's website. This allows us to optimise and monetise the links created according to your location, in order to analyse the general reports provided to us by the platform operating the commercial link monetisation service. This collected information may also be transferred to advertisers and merchants via the platform.

The monetisation platforms and the Edition Ventures Group collect information on sales and visits made on the affiliate link sites. We record, but are not limited to, the following information: the order value, the products purchased and the order identifiers.

The monetisation platforms also collect data on how users connect, information relating to your interactions with the products and services contained in the affiliate links, search results and links, including paid search. They use this data to optimise their products and services, but also to diagnose and resolve any accounting or fraud issues.

The monetisation platforms and, in addition, the merchant sites collect personal information automatically or when you use a service or product they offer.

With regard to the monetisation platforms, and in particular transfers outside the European Economic Area, they undertake to comply with the laws applicable to the protection of personal data.

Edition Ventures collects data relating to the user's IP address and browser character string through plug-ins. These transmit the data to the owners of the corresponding plug-ins and allow certain cookies to be placed on the user's computer. Edition Ventures is jointly responsible for these processing operations with the third parties concerned. However, Edition Ventures' liability is limited solely to the operations for which it is genuinely a joint decision-maker regarding the means and purposes of the processing of personal data.

Edition Ventures collects and transmits this type of data on the basis of one of its legitimate interests, namely improving the visibility of its products and services through these third parties. Failing that, it is up to Edition Ventures to obtain users' consent to the collection and transmission of this data for that commercial purpose.

For these various reasons, we invite you to consult the legal provisions of the merchant sites as well as the personal data processing policies of our monetisation platforms at the following addresses:

• https://services.amazon.fr/standards/politique-de-confidentialite.html and
• https://skimlinks.com/privacy-policies/.

5. Timing and source of processing

In this section we will address the timing and sources of personal data processing. We collect personal data directly through the Edition Ventures Group in relation to the products and services offered, as well as processing data gathered by the authorities or authorised third parties.

a) Personal data collected by Edition Ventures

Edition Ventures processes your personal data in particular when:

  •  you use or visit our websites and social networks;

  •  you create an online user account (at each login or use);

  •  you subscribe to one or other of our newsletters;

  •  you take part in competitions or surveys of our various magazines;

  •  you communicate with the company Edition Ventures and its magazines via the channels provided;

  •  you use affiliate or monetisation links;

  •  you complete a form from Edition Ventures;

  •  you enter into an agreement with one of our magazines; and

  • o following the signature of a contract, you use the services and/or products offered by Edition Ventures.

When you browse our website, we automatically record your IP address and your browser character string. This information is automatically transmitted to the owners of the plug-ins installed on our website (Facebook and LinkedIn). These operations are based on your consent (Article 6.1(a) GDPR) and on the need to pursue certain of our legitimate interests (Article 6.1(f) GDPR), such as administering our website or improving our commercial visibility. Please note, however, that we do not link your data to identifiable natural persons. We invite you to read the data protection policies of the plug-in owners concerned on their respective websites.

Finally, please note that images recorded by surveillance cameras in and around our premises/buildings may be collected and stored by the company Edition Ventures. The processing of this data is put in place for the purpose of securing property and persons and preventing abuse or possible fraud.

b) Personal data collected by third parties

In order to refine our offers and services, personal data may be collected via public sources or sources outside the company (commercial partners or external data providers) and authorised by the data subject when:

  • publications or data are made accessible by official authorities;

  •  personal data is made public by third parties;

  •  personal data is made public by you via websites or social network pages such as your website, your Facebook, your Instagram or your YouTube channel; and

  • you authorise the transmission or publication of your personal data to
    the company Edition Ventures.

Generally speaking, we process the personal data of our subscribers, our customers and
visitors or users of our websites, online shops and services relating to events, online promotion, campaigns, the creation of loyalty programmes and competitions with one or more prizes.

6. Legal grounds and reasons for the processing of your personal data

Respecting your privacy and the proper processing of your data matter to us. To that end, your personal data is collected, stored and used by us only where we first have either a legal basis (under the General Data Protection Regulation) or a valid reason to collect it (known as the purpose of the processing). For example, users browsing one of our web platforms must give their authorisation for us to collect their data and must validate the reason(s) for this processing.

Furthermore, data collection is governed by a principle of minimisation. This means that we collect only the data that is useful and necessary for the processing purposes defined by the Edition Ventures Group in order to carry out its activities.

a) Grounds relied on by the company Edition Ventures for processing data

On the basis of the legislation, we may collect your data:

  • to perform a contract, such as to respond to pre-contractual measures (Article 6.1(b) GDPR);

  • to comply with the legal and regulatory provisions binding on the Edition Ventures Group, such as tax obligations (Article 6.1(c) GDPR);

  • after you have given your consent to the processing of your data, for example so that the Edition Ventures Group can offer you products/services similar to those purchased or which are likely to be of interest to you (Article 6.1(a) GDPR); and

  • to pursue the legitimate (economic) interest of Edition Ventures or of a third party, while ensuring that this interest is balanced against your fundamental rights and freedoms (including the right to privacy): for example, data processing intended to prevent fraud may override your legitimate interests (Article 6.1(f) GDPR).

The legitimate interest of the Edition Ventures Group includes in particular the explicit or automated collection and compilation of personal data to create profiles of subscribers, users or customers based on defined characteristics such as their interests or preferences. This makes it possible to personalise the offers of our products and services across our distribution channels, for example by creating targeted advertising campaigns.

Please note that the Edition Ventures Group provides partner clients with reports covering commercial and statistical aspects in which anonymous data is used.

  • to handle the financial and accounting management of the Edition Ventures Group;

  •  to comply with the legal obligations/requests of duly authorised public or judicial authorities; and

  •  to transfer assets, including personal data, of the Edition Ventures Group to a third-party company in the event of a merger, acquisition or any other legal transaction resulting in such a transfer.

The data processed may be combined with one another to improve our offers, products or services in relation to your own needs.

In the event of new purposes or significant changes to them, we will inform you, via the website, of any adaptations or additions to this statement. On that occasion, you will be free to accept or refuse these changes.

7. Access to and storage of personal data

a) Access to personal data

The personal data provided is incorporated and processed in specific files within Edition Ventures, Chaussée de Louvain 431 D, 1380 Lasne (Belgium).

Access to your data is permitted only to persons authorised by the Edition Ventures Group (referred to as “authorised persons”) for the purpose of fulfilling the tasks mentioned in point 6 b) of this statement.

Authorised persons means those persons who, in the course of performing their duties, have access to the relevant personal data or who are permitted to process it in accordance with their activities and the instructions of the Edition Ventures Group.

b) Personal data retention period

The retention policy applies to the data of customers, subscribers, readers, registered persons, users, browsers and any other persons receiving our newsletters concerning one of our publications.

The retention period for personal data varies according to the purpose of the processing. The personal data collected is kept for as long as necessary to fulfil the service(s) requested. For example, when you subscribe to the newsletter of one of our magazines, your data is kept until you unsubscribe from it.

Our retention policy concerning the data of customers, subscribers, readers, registered persons and any other persons receiving our newsletters concerning one of our publications is 10 years, in order to meet our tax and legal obligations.

Our databases are analysed in order to determine the usefulness and justification for storing each item of data, so as to decide whether to keep it, delete it and/or anonymise it for statistical studies, for example.

8. Minors

The Edition Ventures Group respects the privacy of minors. By minors we mean children under the age of 13.

If you are a minor, you must ask your parent(s) or legal representative(s) before using our products and services.

Edition Ventures strongly encourages the parents of minors to read carefully the general terms and conditions as well as the privacy and cookie policy of the Edition Ventures Group. Reading these texts together with the minors concerned is more than advisable. They will then be able to ask any questions they may have and thereby obtain explanations or clarifications regarding this statement.

The parent(s) or legal representatives of children may, on their behalf, object to the processing of their personal data and request the restriction of processing, access to, deletion, modification or portability of their data. They may also refuse to allow the Edition Ventures Group to make offers or send information about their children to third parties in relation to the Group's products and services.

We recommend using a pseudonym for minors' email addresses (avoiding the use of their first name and surname).

If you find that our products or services have been used or purchased without you having given consent for your minor child, we ask you to send us an email at the following address: privacy@editionventures.be so that we can delete your child's personal data within a reasonable time.

The Edition Ventures Group suggests that parents monitor their children's activities on the internet.

9. Security and confidentiality of personal data

Edition Ventures adopts the technical, physical and organisational security measures deemed necessary and appropriate to protect personal data and privacy against unauthorised access and processing, unlawful processing, loss, accidental damage, and unauthorised modification or destruction of the information collected.

In the course of performing their duties, Edition Ventures' employees and collaborators have access to the company's personal data in order to carry out their tasks properly. These persons are selected and limited in number.

We use reasonable technical and organisational measures such as encryption of our data, pseudonymisation or anonymisation, controlled access to data, or limiting the number of collaborators with access to personal data, etc.

The measures put in place are regularly assessed and updated in order to offer maximum protection to personal data.

This is an obligation incumbent on the company Edition Ventures. It is an obligation of means, not of result. We do not guarantee absolute protection of personal data and we are not liable in the event of malicious or fraudulent intrusion. We will inform you within a reasonable time should such a situation occur.

With regard to the processing of personal data carried out by social networks, monetisation platforms or merchant sites on our (mobile) websites, we are jointly responsible with these third parties only for the processing operations for which we have genuinely jointly determined the purposes and means of processing personal data.

Edition Ventures invites data subjects to read the personal data processing policies of the social networks and of our third-party partners on their respective websites.

10. Transfer of personal data

When we process your data, the Edition Ventures Group is obliged to inform you of the processing of your data, its dissemination, the destination and the purpose of the transfer of your data.

The principle is that the sale and/or transmission of personal data to commercial partners or third parties is prohibited. There are exceptions to this principle:

  • Our successors in title and companies belonging to the Edition Ventures Group may receive personal data for the same purposes as those set out in this privacy policy.

  •  We employ third parties or processors to carry out certain activities. They may use your data in accordance with the task(s) entrusted to them. It is important to stress that processors are not authorised to use your data for their own purposes. We take care to ensure that the management of data by third parties or processors is carried out with all due respect, security and diligence.

  •  Our third-party service providers and partners process data through their services (for example, to provide functionalities or to help improve the security of the Edition Ventures Group's sites), including in particular, but not limited to, the personalisation of any type of content, the selection and delivery of advertisements, reporting and measurement, or generally by any other means involving the processing of personal information for the purposes described in this policy or where you are notified that we are collecting your personal information.

  •  Monetisation platforms process/transfer your personal data via the content distribution network in countries other than the country in which it was collected or in which you reside. Data protection law in the country in which the personal data is processed or transferred may be different or may not be as protective. Nevertheless, their partners/processors must adopt appropriate security measures so that your personal information remains protected in accordance with their privacy policy. All their data transfers are protected by the European Commission's standard contractual clauses and data processing agreements, where required by European data protection law.

  •  As regards the sending of advertising, the third parties responsible for this task receive your data only on condition that you have consented to this processing. You may unsubscribe from their databases at any time in accordance with their policy, or disable cookies, web beacons, log files and other files and technologies used by following the steps described in point 12. In any event, we are not responsible for the contractual relationship between you and them.

  • The law also provides for exceptions to the prohibition on selling and/or transmitting personal data. Where someone seriously damages a person's honour by writing a comment on the forum of one of our online magazines and their username does not make it possible to identify them, the judicial authorities or the police services may ask us for the email address or IP address behind the user in question. If such a request meets the legal requirements, please note that we will be obliged to comply with it. Likewise, in the event of non-payment, your personal data will be transferred to third parties in order to initiate debt recovery proceedings.

  •  When you give us your consent to the processing of your data by third parties, we are legally authorised to transfer it. If you agree to your data being transferred to one of our clients during one of our campaigns, that client may use your data on its own behalf. We are not responsible for the processing of personal data by our clients. Nevertheless, we ensure that the management of data by our clients or partners is carried out with due respect and security and that the data is used with all due care. We will also provide you with the information necessary in respect of such a transfer request (identification of the third party, purpose of the transfer and destination of the processing).

Apart from the cases provided for above, we undertake to inform you by means of an explicit communication of the details of any third parties that would receive your data in a manner other than that described in this section, as well as the purpose of the transfer of your data and the destination of the processing. Where the law requires it, we will ask for your express authorisation and give you the opportunity to object.

Please note that if you are no longer interested in our content or in the campaigns or promotions of our advertisers, you always have the option to unsubscribe using a link at the bottom of our emails.

We also share anonymous data, or categories of persons compiled by the Edition Ventures Group, with third parties in order to provide them with information such as the number of clicks on a given advertisement or information about our categories of readers and their interests. Finally, please note that it is not possible to identify you through anonymous data.

11. The rights of data subjects

Under applicable law, you have and may exercise various rights, where applicable, upon submission of a double-sided copy of your identity card:

Right of rectification: you may request that the personal data held about you be completed or corrected if it is incomplete or incorrect.

Right to erasure: you may request the erasure of your data depending on the case at hand and in accordance with the General Data Protection Regulation. The right to erasure concerns in particular:

  •  data for which you withdraw your consent, provided that consent is the sole legal basis for processing the personal data;

  •  data for which you can demonstrate legitimate grounds;

  •  personal data that has been unlawfully processed;

  •  or where the law so requires.

Please note that we may not be able to erase your data, for example where Edition Ventures must give precedence to the right to freedom of expression and information in a specific case, or where the company must retain the data for legal reasons.

You warrant that the information you provide is accurate, up to date and complete. Where applicable, you undertake to update this information as soon as possible so that it remains true to reality. If it turns out that the data provided is inaccurate or incorrect, the Edition Ventures Group reserves the right to refuse, temporarily or permanently, all or part of some or all of our products or services.

b) Right to object, right to restriction of processing and right to withdraw consent

  •  Right to object to processing, in particular the right to object to the use of your data for direct marketing or commercial purposes.

You have the right to object to the processing of your data for reasons specific to you. Depending on the case, we will carry out a balancing of interests.
As regards the right to object to the use of personal data for direct marketing or commercial purposes, you may stop such use without having to justify your decision. This also applies to the transmission of your data to third parties for the same purposes.
This covers in particular situations in which the data of the persons concerned is processed for personalised offers, is combined as part of profiling, or is used to receive information and offers.

  • Right to restriction of processing

You also have the right to restrict the use of your data for certain processing that you no longer wish Edition Ventures to carry out.

  • Right to withdraw consent

You may at any time withdraw the consent you have given, where applicable, for the processing of your data, without any particular formality, but without this affecting the lawfulness of processing based on consent carried out before such withdrawal.

c) The right to data portability

The data subject has the right to receive the personal data held by the Edition Ventures Group in a structured, commonly used and machine-readable format. Where technically feasible, the data subject may ask Edition Ventures for this data to be transferred directly to a third party of their choice.

The right to portability concerns personal data provided by the data subject through automated means and relating to them, on the basis of processing based on consent or on the performance of a contract.

d) Complaint to Edition Ventures or to a Belgian personal data protection authority

Data subjects always have the right to lodge a complaint with Edition Ventures or with a Belgian personal data protection authority, known in Belgium as the ‘Data Protection Authority’.

e) Privacy and personal data department

To exercise any of the rights mentioned above, please refer to point 15 of this statement.

f) Grounds for refusal

We will not act on your request where:

  • It does not concern (only) you;

  • It concerns the modification of data that turns out not to be incorrect, or that does not rectify it;

  • It concerns the complete deletion of data, whereas the law requires certain data to be retained, for example under tax legislation.

12. Policy on cookies used by the websites of the Edition Ventures Group

a) Definitions

By the following we mean:

  •  Device categories or terminal equipment: devices such as laptop or desktop computers, smartphones, tablets, etc.

We use web beacon technology to build a record of visitors' activities on our (mobile) websites. Thanks to this technology, we can know which parts of the sites are visited, and when and where these visits take place.

The combination of cookies and web beacons/pixel tags makes it possible to attribute web behaviour to a specific user.

Some cookies, files and technologies are installed and administered by third parties. This allows, in particular, the use of certain functions on our sites or the sharing of information via social networks. Edition Ventures accepts no liability in the event of the use by third parties of such files and technologies where they collect, process and/or enrich data in an automated manner.

We take care to ensure that no virus or harmful application is present in the files and technologies used by Edition Ventures.

b) Operation and consent

When you browse our sites, a web banner is displayed to inform you of the use of cookies. This same banner allows you to control your user experience through the cookie management offered on our various sites.

Edition Ventures uses three types of cookies:

  1.  Functional cookies [cannot be unticked] These cookies are essential. They enable an efficient and proper connection while also guaranteeing your security in the online environment.
